By Placing An Order With Rooster Tail Designs, You Agree To The Following Terms:
Turnaround Rooster Tail Designs estimates that all orders containing only flat pieces will be ready to ship within 7-10 business days from the business day we receive the completed order. All orders placed before 3pm Central will be considered ordered that business day. Any order placed after 3pm will be considered ordered on the following business day. Rooster Tail Designs will do everything in its power to correctly produce your job in a timely manner, but cannot guarantee a specific shipping or arrival date. The 7-10 business day turnaround is an estimate, and is not to be confused with a guarantee. Orders printed on 14pt C2S and aqueous coated are the only products that are offered in those time estimates. If any postproduction work needs to be done to the order then the turnaround is then null and void. Finishing includes but not limited to: Folds, Scores, Perforations, Die-cuts, and Drilling.
Payment Terms All orders must be prepaid due to the speed of our turnaround. Your order will not go to print until all checks have cleared. This could cause a significant delay in your order. Under no circumstances will Rooster Tail Designs print a job COD or give credit terms.
Quotations/Estimates Prices posted on this website are subject to change without notice. Written estimates are good for 15 days. An estimate not accepted within 15 days may be changed.
Orders Rooster Tail Designs reserves the right to use its sole discretion in refusing to print anything it deems improper or known to be illegal. Rooster Tail Designs is not liable for any damages resulting from unwitting violation of copyright laws or illegal use of trade names or slogans. The client guarantees the legal title of all matter submitted to Rooster Tail Designs for printing and/or publication.
Cancellations Canceled orders require compensation for incurred costs and related obligations at the time of cancellation. A minimum charge of $75 is applied to jobs canceled before plating occurs (usually 3 hours after your proof is approved). No refunds will be given for orders canceled after plating has occurred.
Free Design on Printed Materials Rooster Tail Designs offers free design with any printing order. Free Design does have a 3-hour time limitation. If in the opinion of any Rooster Tail Designs employee that a design is deemed beyond standard practices, Rooster Tail Designs can charge a design fee starting at $75/hour. The client will be warned of such charges prior to them incurring. Charges will only be made or enforced under extreme circumstances when a client goes far beyond their allotted Free Design time.
The free design is only valid for individuals who print and follow through with their order. If at any time during the proofing process you decide to back out/cancel the print order and would like a refund, you will be charged for the design up to that point (minimum $75). Once the difference is determined you will receive your refund along with the current digital format of the postcard/business card design.
Accuracy of Specifications Quotations are based on the accuracy of the specifications provided. Rooster Tail Designs can re-quote a job at the time of submission if the art does not conform to the information on which the original estimate was based. Orders placed with Rooster Tail Designs are to the client's knowledge correct, and there are no conditions or agreements relating to the order which are not written or accompanying said order.
Liability Rooster Tail Designs’ liability shall be limited to the stated selling price to the customer of any defective goods, and shall in no event include special, consequential, incidental, indirect or similar damages, including without limitation, lost profits. Rooster Tail Designs warrants that every product manufactured by it meets industry standard for such product and is free of any material defect in workmanship. IT IS EXPRESSLY AGREED THAT THIS WARRANTY IS IN LIEU OF ALL WARRANTIES OF FITNESS FOR PARTICULAR USE AND MERCHANTABILITY. Rooster Tail Designs makes no other warranty and no actions or words of Rooster Tail Designs or its officers, employees or agents shall constitute a warranty.
Indemnification The customer represents that it has the legal right to produce all printed materials ordered from Rooster Tail Designs. In the event that a charge, claim or demand, or arbitration, action or proceeding (collectively, a "Claim") is made or commenced against Rooster Tail Designs based upon, relating to or arising from the alleged wrongful acts of the customers, or alleging that the printing performed or product produced by Rooster Tail Designs ordered by the customer: (a.) infringes any copyright, patent or other proprietary right of any person; or (b.) contains matter that is libelous, slanderous, defamatory, scandalous or obscene, the customer shall indemnify and hold Rooster Tail Designs harmless from and against any loss, damages, cost and expense arising from or related to the Claim including without limitation; (1.) defending Rooster Tail Designs against any such Claim (2.) paying any judgment or award against the customer; and (3.) reimbursing Rooster Tail Designs for any legal fees and expenses it reasonably incurs in responding.
Electronic Manuscripts/Images It is the client's responsibility to maintain a copy of the original computer files, artwork and transparencies. Rooster Tail Designs is not responsible for accidental loss or damage to media supplied by the client or for errors on supplied artwork furnished by the client. Until Rooster Tail Designs can evaluate digital input, no claims or promises are made about our ability to work with jobs submitted in digital format, and no liability is assumed for problems that may arise. Any additional translating, editing, or programming needed to utilize client-supplied files will be charged at our current rates. Rooster Tail Designs does not archive your work for longer than it takes to produce the final product. Please save your work!
Rooster Tail Designs Designs All designs made by Rooster Tail Designs are the property of Rooster Tail Designs. All images and reproductions remain on our servers for a period of 1 year before being archived to DVD. Designs may be purchased for $175 each. You will be supplied a PSD, and PDF format.
Alterations/Corrections Client alterations must be specified in writing and must include all corrections or changes from the original specifications. Such work will be charged at our current rate of $75/hour.
Prepress Proofs When requested by the customer, Rooster Tail Designs will submit color hard copy proofs for the customer's review and approval. A charge for the proof will be required and may take up to 10 days to provide the hard copy proof. Proofs must be returned to Rooster Tail Designs marked "O.K." or "Revised Proof Required" and signed by the customer. Until the proof is returned, no additional work will be performed. Rooster Tail Designs will not be responsible for undetected production errors if:
Proofs are waived by the client; The work is printed per the client's written OK; Requests for changes are communicated verbally. All requests for changes of any kind must be made in writing to avoid mistakes. Any proof request waives our turnaround guarantee.
Digital Proofs To Adhere to a timely manner, we strongly encourage the use of our digital format proofs. We will provide proofs either online or via email. CLIENTS ARE RESPONSIBLE FOR PROOFING ALL ASPECTS OF PRINTED DESIGN WORK.
The Guarantee of Color and Exact Color Matching Because of differences in equipment, paper, inks, and other conditions between color proofing and production pressroom operations, a "pleasing color" variation between color proofs and the completed job [as determined by generally accepted trade technical methods] is to be expected. When such a variation occurs, it will be considered acceptable performance. We do not guarantee an exact color match to the art submitted. If the art is submitted as a any color mode other than CMYK we will convert the color mode to CMYK. If there is a color shift we are not responsible for that color shift. Inkjet Proofs Inkjet and laser prints are known to look substantially different than offset printing. We offer quick turnaround and low prices by printing to a "pleasing color" standard, using standard ink densities. There is no guarantee that your finished piece will match your printed sample. This is due to the varying results from different output devices including inkjet printers, continuous tone proofing devices, and film-based proofs.
Overruns/Underruns Rooster Tail Designs will normally deliver the exact quantity of goods ordered plus a small additional amount. There is no extra charge for the additional amount. In the event of an underrun, Rooster Tail Designs may bill for the actual quantity delivered. The generally accepted trade practice is plus or minus 5%.
Delivery Charges for delivery of materials and supplies from the client or the client's supplier to Rooster Tail Designs are not included in quotations unless specified. Rooster Tail Designs is not responsible for delays and/or damage incurred during shipping. Title for finished work passes to the customer upon delivery to the carrier at shipping point; or upon mailing of invoices for the finished work or its segments, whichever comes first.
Claims Claims for defects, damages, or shortages must be made by the client in writing no later than 10 calendar days after delivery. If no such claim is made, Rooster Tail Designs and the client will understand that the job has been accepted. By accepting the job, the client acknowledges that Rooster Tail Designs' performance has fully satisfied all terms, conditions and specifications.
Disputes & Venue For legal purposes, the venue for any dispute shall be Huntsville, AL., USA
Right to Subcontract Rooster Tail Designs shall have the right to assign any portion of the work required to another contractor.
Workmanship Guarantee We guarantee all orders to be free of defects in workmanship. If any order does not match the generally accepted trade standards, we will reprint the order or issue the customer a refund at our discretion.
Privacy Statement Any information Rooster Tail Designs collects from order processing or from any inquiries is not shared with any other company. Your information is only used for contact, billing, and shipping purposes. Samples Rooster Tail Designs might use your product for samples or advertising purposes unless specifically advised not to by the client.
Design Specifications Business card files must have an 1/8" bleed and an 1/8" safe area. Files which do not meet these requirements will be rejected. All files submitted for sizes larger than a business card must have a 1/4" safe area. We take no responsibility for cutting text or images which exist outside our required safe area. Please check your design before submitting it for print. Finished sizes for pieces larger than business cards may vary by 1/8". If you require an exact size, please call for a custom quote. Please refer to our business card section for further information.
All Sales Are Final Since each job is custom created for its owner, it can not be reused or resold.
Shipping Changes and Shipping Methods Shipping methods selected on our online ordering page are final and cannot be changed once the order is submitted. We will not upgrade or change the shipping method that was selected on our online ordering page. Also, we will not use any other form of shipping that is not one of our pre-determined shipping options. We will not use client's account numbers, regardless of the carrier for the shipping of orders.
Changes Rooster Tail Designs may change, modify, add or remove portions of this policy at any time, and any changes will become effective immediately upon being posted unless stated otherwise.
